The two-part exemption test

To be exempt from FLSA overtime, an employee must meet BOTH a salary test AND a duties test. Meeting only one is not enough for the exemption to apply.

Salary threshold (2025)

For the white collar exemptions, employees must earn at least $684 per week ($35,568 per year) on a salary or fee basis. The DOL has proposed increases โ€” check current DOL guidance for updates.

Highly compensated employees

Employees earning over $107,432 per year are exempt under a simplified duties test โ€” they only need to customarily and regularly perform one of the exempt duties. This threshold is separate from the standard salary level.

Frequently Asked Questions

No. Job titles don't determine exemption status โ€” actual duties do. A 'manager' who spends most of their time doing the same tasks as their direct reports may not meet the executive exemption's duties test.
Yes, and it's unfortunately common. If you're classified as exempt but don't genuinely meet both the salary and duties tests, you may be owed back overtime pay for up to 2-3 years. Contact the DOL Wage and Hour Division or an employment attorney.
Employers who violate FLSA overtime provisions can be liable for: the unpaid overtime wages, an equal amount in liquidated damages (doubling the amount owed), and attorney's fees and court costs. The statute of limitations is 2 years (3 for willful violations.)
